(Applies to regular ground shipments and truck freight)
While we do our best to ensure your order is properly packaged before it leaves our facility, on occasion product may get damaged, be it a transport mishap, mishandled box, or a not so happy delivery driver. If this happens please reach out to us as soon as possible. Then follow these steps:
DO NOT ACCEPT YOUR DELIVERY without taking note of any damage that might have occurred on the delivery form. Shipping companies will not fulfill an insurance claim without the damage being noted by the customer. We cannot be held responsible for any product or powder coat damage incurred during transit. Goliath Off Road will facilitate a claim, on the customers behalf with the carrier, but it is subject to the conditions listed above being met.
IF the damage is so severe that it is obvious the product inside has been damaged, do not sign for the item and refuse your delivery. If you sign for the package the shipping company will view it as rightfully yours and that you have accepted it AS IS.
IF the damage is less severe and the goods are intact, you can make a note of the damage on the delivery slip (or electronically with the driver) before signing for the delivery. This will begin the claims process and we will help you file a claim with the shipping company, but it will be your responsibility to replace or repair the product. All awarded claim money will be sent to the customer as reimbursement for shipping damage unless a prior arrangement has been made.
IF the package doesn’t require a signature and it has been delivered while you were not present, and you discover that the package has been delivered damaged, please take photos of the damaged package before opening it. Next contact us via phone 321-203-8823 or email sales@goliathoffroad.com right away to explain that the package has been delivered damaged.
Goliath Off Road, LLC IS NOT LIABLE FOR PACKAGES THAT ARE MISPLACED OR STOLEN AFTER THEY HAVE BEEN DELIVERED. If you are worried about your shipment potentially getting stolen, please have the item delivered to a different address where someone will be available to receive it. After an order is shipped, you will receive tracking information so you will know when the item will arrive. Goliath Off Road will not refund or reimburse your order in any way if the package is misplaced or stolen once the tracking info shows delivered.
Shipping amount provided online is an estimate and actual costs may vary. In some cases the online shipping calculator may not accurately estimate shipping. In the event a difference in shipping is found, our staff will contact you to advise of the shipping or freight charge difference. If we can not contact you we will void the order until we are able to make contact.
Shipments outside the U.S. or to AK or HI will have a higher shipping rate and require a shipping quote before ordering. Please email sales@goliathoffroad.com with your full shipping address and a list of the products you would like to order. We will get a shipping rate quote from our shipping company and respond letting you know how much the charges will be. Our website will not accept addresses going to AK or HI or outside the U.S. so you will need to contact us to get a shipping rate quote first and then we can explain to you how to proceed with your order.
Truck Freight Shipments
Large items like full size front and rear bumpers, rock sliders and some roofracks ship to the freight hub nearest the customers residential address, unless a commercial address is provided in which case product can be sent directly to the commercial address. Please specify business name in the shipping address section of the order form so that we know it is a commercial address. IF A BUSINESS NAME IS NOT SUPPLIED, THE SHIPMENT WILL BE SENT TO THE NEAREST FREIGHT HUB. Goliath Off Road, LLC WILL NOT BE HELD RESPONSIBLE FOR ANY STORAGE FEES ASSOCIATED WITH FREIGHT SHIPMENTS IF THE CUSTOMER CANNOT PICK UP THEIR SHIPMENT FROM THE FREIGHT HUB WITHIN FOUR DAYS OF DELIVERY. GOLIATH DOES NOT APPROVE THE USE OF A LIFT GATE OR ANY OTHER ACCESSORIAL ITEMS AT THE TIME OF DELIVERY, C4 WILL NOT BE HELD RESPONSIBLE FOR SUCH COSTS. Customer must provide a forklift or other means of removing their shipment from the truck when it is delivered to a commercial address.
If you want to get it shipped to residential address you have to contact us to check possibility and cost.
In the event a motor freight shipment must go to a residential address there will be an additional residential delivery fee charged by the freight carrier. The freight companies charge this residential delivery fee to setup a drop off appointment and to schedule a smaller truck to make the delivery in the residential area. Often there are times where a motor freight carrier cannot access a residential area due to tight turning radiuses, load restrictions, etc. Using a commercial address on your motor freight delivery will help avoid delivery restrictions and delays, insure prompt delivery, avoid the need to set up a drop off appointment, and will also avoid the freight companies residential delivery fee. Motor freight shipments being delivered to a residential address may also require additional days for service and delivery. Transit times vary between the numerous different shipping companies, depending also on the product ordered and ship-to location
We do reserve the right to use different carriers to ensure you get your product in a economical time saving means.
Local sales and Pick-ups
All local purchases, local work, and orders that are picked up by the customer are subject to Florida sales tax which will be totaled into the final invoice of which the customer is responsible. All of our products are available for local pick-up at our warehouse location :
21810 State rd 46, Mount Dora, FL 32757.
Back ordering of some products may still apply.
Pick-ups must be scheduled in advance.
Warranty
Goliath Off Road warranties our products against defects in materials and workmanship for a period of one (1) year from the date of original purchase. Due to the intended use of our product, our warranty does not cover product damaged sustained from offroad use or accidents. Product hardware, accessories, and wear items (tie rod ends and boots, latches, lights, bolts, etc...) are not included under any part of our warranty. It is the sole discretion of Goliath Off Road to determine warranty eligibility. The warranty is only applicable to the original purchaser of the product; all names of customers are held in a database for reference. All returns will be checked, and any modification to the original product design, functionality, or use, by said customer voids all warranty eligibility. Installation labor, paint, powdercoat, or any other finishes are not covered by warranty. We do not cover shipping, insurance, import fees, or duties and taxes for the returned product.
We reserve the right to remedy defects in workmanship or materials in one of this ways:
- Goliath Off Road will issue replacements components to the customer that deems defective or inconsistent with the quality of its brand.
- Goliath Off Road will elect to issue the customer a full or partial refund for the defects or damages of the product.
- Goliath Off Road will pay the cost of having a shop near the customer perform repairs on the product if it is deemed that this option is more affordable and will satisfy the customers warranty request.
This warranty does not cover damage to the finish of powder coated products. Goliath Off Road is not responsible for defects that are not in control of Goliath Off Road such as, trail damage, highway damage or car accidents, overloading, incorrect assembly, poor maintenance practices or damaging acts of god such as extreme weather e.g.: hail, flooding, lightning, extreme wind.
Limitation of Liability
If the Goliath Off Road product fails to work as warranted above, Goliath Off Road's maximum liability under the above warranty is expressly limited to the cost of repair or replacement of any products or components that malfunction in conditions of normal* use. Except as indicated above, in no event will Goliath Off Road be liable for any damages caused by the product or the failure of the product to perform, including any lost profits or wages, business interruption, loss of use or any other commercial or economic loss of any kind, or special, incremental, or consequential damages. Goliath Off Road is not liable for any claim made by a third party or made by you for the third party. This limitation of liability applies whether damages are sought, or a claim made, under this limited warranty or as a tort claim (including negligence and strict product liability), a contract claim or any other claim. This limitation in liability cannot be waived or amended by any person. This limitation of liability will be effective even if you have advised Goliath Off Road of the possibility of any such damages or even if such possibility were reasonably foreseeable. This limited liability gives specific legal rights. You may also have other rights that may vary from state to state or from county to country. You are advised to consult applicable state or country laws for a full determination of rights
